This agreement is made on the date set out in the Details Schedule between People Medical Consulting Pty Ltd (ACN 601 431 814) (“People Medical”) and the client identified in the Details Schedule (“the Client”). This agreement can be accepted by the Client executing and returning it, or by the Client receiving Candidate Information from People Medical and continuing to communicate with People Medical about Candidates or Roles
In this agreement:
“Business Day” means a day that is not a Saturday, Sunday or gazetted public holiday in Brisbane.
“Candidate” means any individual who is identified or Introduced to the Client by People Medical.
“Candidate Information” includes a Candidate’s CV, contact details, qualifications and experience, employment history, or other personal details.
“Credential” means to verify the claimed qualifications, experience and professional standing of a Candidate.
“Details Schedule” means the schedule to this agreement specifying the details of our agreement, including Client details
“Fee” means the fee payable by the Client to People Medical for Services under this agreement, as specified in the Service and Fee Schedule.
“Introduce” includes to provide Candidate Information or to arrange or facilitate an interview with a Candidate.
“Other Medical Practitioner” refers to any Practitioner, not a General Practitioner, placed with a salary.
“Placement” means employment or engagement of a Candidate by the Client or Related Body Corporate of the Client, whether temporary or permanent, and whether contract, casual, part-time or full-time.
“Role” means a role at the Client or a Related Body Corporate, in which a Candidate may be Placed.
“Related Body Corporate” has the meaning given in the Corporations Act 2001 (Cth).
“Service and Fee Schedule” means the service and fee schedule attached to this agreement, as updated by People Medical from time to time.
“Services” means the recruitment services provided by People Medical to the Client under this agreement, including the provision of Candidate Information to the Client, and provision of the services described in the Service and Fee Schedule at the request of the Client.
“Term” means the term of this agreement, as described in clause 2.
During the Term:
then that Candidate is taken to have been recruited by People Medical for the Client (and the applicable Fee is payable).
Subject to this clause, if a permanent Placed Candidate ends his or her Placement within 12 weeks after the Placement starts, People Medical will refund Fees (but not external costs such as official application fees) as follows: (a) within weeks 1-4: 80% refund; (b) within weeks 5-8: 40% refund; and (c) within weeks 9-12: 20% refund.
VIP Recruitment Services Agreement
Outlined below is the fee schedule for our VIP package, inclusions to that package and the subsequent fees and charges. There are also additional options you can select. An invoice will be provided upon signing of these terms which signals the commencement of the arrangement. Subsequent invoices will be invoiced each month on the same date as when the agreement commenced, or the closest business day.

By signing up to VIP Service, you acknowledge that you have read and understood the Fees above and the terms below. If you fail to return a signed acceptance but continue to use our services, this will be taken as acceptance of this engagement and its terms and conditions.
The objective of our professional services is to provide support to the Client in the sourcing of suitable applicants for their Business, acting on their behalf when advertising, and contacting candidates.
Either party may terminate this Agreement after the 12 month initial term by giving written notice. Upon termination, a termination fee may be charged to the sum of equivalent to one months fee, depending on the level of work completed for that calendar month. This can be clarified in our fee schedule.
Our team will collect, retain, record, use and disclose personal information about you, in accordance with the Privacy Act 1988, to persons and/or legal entities who are a Solicitor or any other professional consultant engaged by People Medical, a debt collector, credit reference organisation and/or any other individual or organisation which maintains credit references and/or default listings. We may also make enquiries regarding your credit worthiness; to exchange information with other credit providers in respect to previous defaults and to notify other credit providers of a default.
If you cannot pay your invoice/s on time, please contact our team to arrange an alternative agreement about payment. We may charge interest at the rate of 18% per year, accrued and compounded monthly, on overdue invoices. Invoices overdue by more than 10 Business Days may be passed to a collection agency. You will then be responsible for any debt collection and recovery costs (including legal costs on a solicitor and own client basis) incurred in taking steps to recover payment. Your default will also be listed with the appropriate credit reporting agency.
If at any stage through your working with us a problem is identified, both parties agree to advise the other in writing immediately for resolution. If a suitable resolution cannot be made between the client and consultant, the matter will be referred to the Team Manager who will review the work completed and discuss the matter with both parties and determine an outcome. If a suitable outcome cannot be agreed then a 3rd party, agreed upon by both, will be identified and requested to make a final decision on the matter.
The personal information you provide to us is collected, used and disclosed to other departments within People Medical Consulting to provide the best service possible. Candidates who apply to your roles will be given the option to opt out of the People Medical database, and all candidates will be considered for your Business prior to being considered for other roles. Other roles will only be offered to the Applicant upon approval from the Client.

Retained Recruitment Services Agreement

We’re People Medical Consulting Pty Ltd – we collect your personal information from you for the purpose of assisting you in finding either a staff member, or a new job. Any and all information that we collect will be held by our staff members on both our server and is accessible on portable devices. What Are We Using It For?
The reason we do this, first and foremost, is to ascertain that you have the right qualifications and that we have all the information that we need to represent you to the best of our abilities. It gives us the information we need to advise you appropriately on what you may need to do for us to best assist you. There are also things that we need to have on file, so that when we find you a job or a staff member, we’re able to complete the required documentation and also – to meet our own compliance requirements! Other information we ask you, may be to determine what you need to be fully satisfied professionally.
We will not be collecting information other than what is necessary for us to use in the course of our work
We won’t be using it for unlawful discrimination or for any other reason than we feel it’s needed to do our best for you – you have the right to question us about this information at any time.
