Introduction: The subclass 482(TSS) visa allows employers in Australia to sponsor overseas workers on a temporary basis. This visa is designed to address the shortage of highly skilled workers in the local labour market. In this blog, we will provide a step-by-step guide to the application process for the subclass 482(TSS) visa, including the requirements for both employers and visa applicants.
Step 1: Sponsorship Application: The first step in the application process is the sponsorship application. The employer must meet the following criteria:
- Actively and lawfully operating in Australia or overseas.
- No adverse information known that could affect the business’s suitability as an approved sponsor.
- Certain businesses may be eligible for accredited status, which provides priority processing for all TSS nomination and visa applications.
Step 2: Nomination Application Once the sponsorship application is approved, the employer can proceed with the nomination application. The nominated position must meet the following criteria:
- Conditions of employment should be no worse than those for Australians performing equivalent work in the same location.
- The position should be included on the occupation list except where an existing Labour Agreement applies.
- Labor Market Testing (LMT) is required, which involves advertising the position within the last 4 months for a period of at least 4 weeks.
- Skilling Australians Fund Levy – Sponsors must pay the Skilling Australians Fund (SAF) levy for EACH subclass 482 nomination lodged with the DOHA. The amount payable varies based on the sponsor’s annual turnover and the visa applicant’s proposed period of stay in Australia. For sponsors with an annual turnover of LESS THAN AU$10 million, the SAF levy is AU$1,200 for each year of the nominated visa applicant’s proposed period of stay i.e. AU$1,200 for a 1-year visa; AU$2,400 for a 2-year visa and so forth. For sponsors with an annual turnover of AT LEAST AU$10 million, the SAF levy is AU$1,800 for each year of the nominated visa applicant’s proposed period of stay i.e. AU$1,800 for a 1-year visa; AU$3,600 for a 2-year visa and so forth. The SAF levy must be paid upfront, at the time that the nomination is lodged.
Step 3: Visa Application The final step in the application process is the visa application itself. Visa applicants must meet the following requirements:
- Skills (qualifications and/or work experience) that match those required for the nominated position.
- At least two years of full-time experience (or part-time equivalent) in the nominated occupation or a related field. This will change to one year of full time experience from November 2024.
- Genuine intention to work in the nominated position.
- Mandatory licensing, registration, or professional membership requirements should be met.
- Adequate arrangements for health insurance during the stay in Australia and meeting relevant health and character criteria.
- Required level of English proficiency, which can be demonstrated through various tests such as IELTS, OET, TOEFL, PTE, or CAE.
Fees and Charges: Throughout the application process, there are various fees and charges involved. These include the DOHA Sponsorship Application Charge, CA Legal and Migration Professional Fee, DOHA Nomination Application Charge, and the Skilling Australians Fund Levy. The exact amounts depend on factors such as the sponsor’s annual turnover and the proposed period of stay for the visa applicant.
Conclusion: Applying for the subclass 482(TSS) visa involves three main steps: the sponsorship application, the nomination application, and the visa application. Each step has specific requirements that must be met by both the employer and the visa applicant. It is crucial to understand these requirements and seek professional guidance to ensure a smooth and successful application process.
Applying for the subclass 482(TSS) visa can be a complex process, but with the right guidance and understanding of the requirements, it can be successfully navigated.
